1. Acceptance of Terms

Welcome to Supfit. These Terms of Service ("Terms") govern your access to and use of the Supfit mobile application and website located at supfitapp.com (collectively, the "Service"), operated by Supfit ("Company", "we", "us", "our").

By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

2. Eligibility

To use Supfit, you must:

• Be at least 18 years of age
• Not be prohibited from using the Service under the laws of your jurisdiction
• Not have a previously terminated Supfit account (unless we have given express written consent to re-register)

3. Account Registration

To access the Service, you must create an account. When registering you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorised access to your account at support@supfitapp.com
• Accept responsibility for all activity that occurs under your account

You may not create more than one account, share your account with others, or use another person's account without permission.

4. The Supfit Service

Supfit provides:

• A platform for individuals to track fitness, nutrition, and health metrics
• AI-generated personalised workout and nutrition plans, delivered through Maya, Supfit's AI health coach
• A structured daily journey (meditation, yoga, workout, meals, wind-down) with guidance and reminders from Maya
• Progress tracking, goal setting, and a weekly health score

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

5. Health & Medical Disclaimer

You acknowledge and agree that:

• Any fitness plans, nutrition suggestions, or health recommendations provided through Supfit (including those generated by Maya, our AI health coach) are for general informational and wellness purposes only
• You should consult a qualified healthcare professional before starting any new exercise programme, making significant changes to your diet, or acting on any health information provided through the app
• Maya is an AI system, not a medical professional, and her guidance should not substitute professional medical care
• If you experience chest pain, difficulty breathing, fainting, or any other serious symptoms during exercise, stop immediately and seek emergency medical attention
• You use the Service entirely at your own risk

Supfit shall not be liable for any injury, illness, or adverse health outcome arising from your use of the Service or reliance on any content provided through the Service.

6. Payments & Future Subscriptions

Supfit is currently free to download and use. All features are available at no cost while the app is in this phase.

We plan to introduce optional in-app purchase subscriptions in a future release (for example, expanded Maya features or additional plan personalisation). Before any paid tier goes live, we will update these Terms and notify you in advance, and no charge will be applied without your explicit consent at the time of purchase. Once introduced, paid features will be governed by the terms below:

• Subscription billing: Paid subscriptions will be billed in advance on a recurring basis (monthly, quarterly, or yearly, as specified at the time).
• Cancellation: You will be able to cancel your subscription at any time through your app store account. Cancellation takes effect at the end of the current billing period.
• Refunds: Refunds will be handled according to the policies of the platform through which you purchased (Apple App Store or Google Play). We will not offer refunds for partially used subscription periods except where required by law.
• Price changes: We reserve the right to change subscription prices with at least 30 days' notice. Your continued use after a price change constitutes acceptance.
• In-app purchases: All in-app purchases will be processed by Apple or Google and are subject to their respective terms.

7. User Content

When you submit content to Supfit (including profile information, reviews, photos, workout logs, and any communications), you grant Supfit a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, store, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to post the content
• The content is accurate and does not violate these Terms or any applicable law
• The content does not infringe any third-party intellectual property, privacy, or other rights

Supfit does not claim ownership of your personal health data. You retain all rights to your health and fitness data.

8. Prohibited Conduct

You may not use Supfit to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Post false, misleading, or fraudulent content
• Harass, bully, or harm other users
• Attempt to gain unauthorised access to any part of the Service or another user's account
• Use automated tools, bots, or scrapers to extract data from the Service
• Transmit malware, viruses, or malicious code
• Engage in any activity that disrupts or overloads the Service
• Solicit personal information from other users for non-platform purposes
• Use the Service for commercial solicitation unrelated to fitness and wellness

Violation of these prohibitions may result in immediate account suspension or termination.

9. Intellectual Property

The Supfit name, logo, app design, software, and all content created by Supfit (including Maya) are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

This does not affect your ownership of content you yourself create (your health data, your profile content, your workout logs).

10. Account Termination

Termination by You

You may delete your account at any time from within the app (Settings → Account → Delete Account) or by emailing support@supfitapp.com. Deletion is permanent and cannot be undone.

Termination by Supfit

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• We are required to do so by law
• Your conduct poses a risk to the safety or security of other users
• You use the Service in a fraudulent or deceptive manner

Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will remain in effect.

11. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPFIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

Our total aggregate liability to you for any claims arising under or in connection with these Terms or the use of the Service shall not exceed the greater of (a) the amount you paid to Supfit in the 12 months preceding the claim, or (b) ₹5,000 INR.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Supfit is primarily designed for users in India. Any disputes arising from these Terms that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in India.

The Service complies with the Information Technology Act, 2000, the Digital Personal Data Protection (DPDP) Act, 2023, and other applicable Indian laws.

If you access the Service from outside India, you do so of your own volition and are responsible for compliance with local laws.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Displaying a notice inside the Supfit app
• Sending an email notification to your registered email address
• Updating the "Last updated" date at the top of this page

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
